A civil fraud is the act of
intentionally making a false representation of a material fact,
with the intent to deceive,
which is reasonably relied upon by another person
to that person's detriment.
Richardson's false representation was making a promise of future performance to Barnstable voters, with an intent not to perform as promised.
Richardson will not vote for a mayoral form of government under any circumstance.
7,000 Barnstable voters signed a petition asking for a charter commission to author a new town charter.
In November, 2007 voters in a landslide approved the creation of a new charter commission.
Richardson ran as a candidate for charter commission leading voters to believe he would participate in a significant change in the charter that would be submitted to the voters for approval.
Richardson was a twelve-year
member of the town council
who was termed out by the charter’s three-term limitation.
Councilor Fred Chirigotis is a novice politician and Richardson’s son-in-law, who is keeping the seat warm for him until Richardson is eligible to run again.
Richardson is a daily patron of the Centerville Post Office, and was accosted a dozen times by Charter Commission signature gatherer, John Julius, the citizen in the You Tube video.
Each time Richardson refused to sign the petition because he felt the charter wasn’t “broken.”
7,000 other Barnstable voters signed the charter petition that Barnstable voters passed in a landslide.
The 7,000 voters wanted more of a voice and accountability in town government, and elected Roy Richardson to write a charter for them, but Richardson won't comply in the end.
Richardson will go through the motions of non-bias during charter commission hearings, but in the end, he'll vote for the current charter with some minor changes.
You can bet the ranch on it.
Unlike everywhere else in the United States where voters get to elect both executive and legislative branches, Barnstable voters get to vote for one of thirteen councilors in the legislative branch, but not the executive branch, town manager who is hired by a vote from seven councilors from other precincts.
This year voters in every state in the union have had, or will have, the opportunity to elect the potential presidential candidate of their choice by party affiliation.
Barak Obama and Hillary Clinton are virtually deadlocked in the Democratic primaries, while the Republicans settled in for McCain.
In November all voters in the country will have the opportunity to participate in the election of the Chief Executive of the United States, the House of Representatives and one third of the Senate.
Last year folks in Massachusetts participated in primaries and the general election to elect the Governor (Executive Branch), and General Court (Legislative Branch).
Also last year voters in 349 Massachusetts communities elected mayors, boards of selectmen, city councils, and in larger towns and cities; elected town meeting representatives.
In Watertown, Winthrop, and Barnstable voters did not vote for the Executive Branch.
Watertown and Winthrop voters elected a plurality of city councilors, who in turn, hired a municipal manager.
Barnstable voters elect only one of thirteen councilors who then hire the executive branch.
Since Watertown and Winthrop voters elect a majority of the council, all at-large councilors consider all voters as constituents.
Conversely because Barnstable elects councilors on a precinct basis, each voter is a constituent of only one of the thirteen who hire the executive branch, the town manager.
With only a one-twenty-sixth share of town government, there's a disconnect with town hall.
Barnstable voters typically hear from their precinct representative, "I'm only one of thirteen."
Each of the 7,000 voters who signed the charter petition said they want to elect both branches in town hall, except Charter Commissioner,
and former Town Councilor, Bob Jones.
Richardson’s disingenuousness manifested itself when he took out nomination papers.
He knew he wasn't going to give the voters what they wanted, a new charter.
The Town Council authored some tweaks to the charter in November which voters nixed because they wanted a new charter in which both the executive and legislative branches were accountable to them.

pompous ass, Bob Jones, said at Thursday's Charter Commission hearing, that the current charter is in need of tweaks only, and can be counted on to vote against a mayoral form of government.

Susan Rohrbach, is a a town hall groupie, who won’t vote for a mayoral form of government.

Richard Clark, claims to be open minded, and may be disqualified from the Charter Commission if the court rules against Greg Milne, because he will also hold two elective town offices (elected as Moderator of the Barnstable Fire District.)
Charter Commissioner, John Alden, told me that he is opposed to a mayoral form of government.
Unless Greg Milne is seated to the position he was duly elected on the Charter Commission,
it looks like this charter commission will be as big a dud as the one in 1999.
COG plans to circulate a new charter commission, because voters will reject the warmed over version of the current charter expected from this charter commission, just like they did in 1999.
Town government is the government closest to us which means voters should feel welcome and not alienated.
After nearly twenty years of the current charter, it's a small wonder there's massive voter apathy.
In November many precincts experienced single digit voter turn outs, but in the dead of winter on Super Tuesday in meaningless primaries, the turn-out was 80%.
Is an I.Q of 160 good?

I also spoke a couple nights later before the charter commission and both Mr. Richardson AND FORMER COUNCILOR Bob Jones tried to defend all this garbage. NICE try fellas. But the voters here aren't that dumb! We can SEE with our own eyes. Bob Jones tried valliantly to let me know that I DO NOT speak for him....... Yeah Bob, I KNOW. YOU and a few other PHONY former councilors have made it perfectly clear WHY you are on the charter---- to simply PROTECT the good ole boy network as we all know it! And Roy Richardson is much of the same. Roy walked past Jim Walsh and myself more than a dozen times when we were in front of the Centerville Post Office and we asked him to sign EVERY time but he always refused. So does ANYONE know if Mr. Bigshot EVER signed the petition, because to the BEST of my knowledge, he never did. Nor has anyone else verified that he ever signed. Gee what a surprise.........
So isn't this so nice? We had a good HONEST HARDWORKING GROUP of some 20 to 30 VOLUNTEERS who spent a year and a half in the heat, rain, the cold and whatever else collecting almost 7,000 signatures because MOST VOTERS saw what WE saw: that our Gov't here IS badly broken, and that our charter IS badly BROKEN. So we spent all that time and energy and WHO gets elected? A few HACKS who now want to sit there and TRY to tell us all, in the words of Bob Jones, "that there is not really much wrong with our gov't and charter". Bob, REALLY? Then can you tell us WHY some 7,000 people SIGNED the charter PETITION in the first place?
If people want the truth, log on to the town web site. Search Videos and log into Special Events. Check out that last Charter Commission meeting from last Thursday night. I had no clue they would use that format. Usually they sit like the council does and we simply speak to them. This time they had a roundtable and they basically tried to 'intimidate' me. Nice try Roy Richardson and BOB JONES........ But if ANYONE should be OFF the charter commission, it should be these TWO! It is obvious that NEITHER wants change and they are just there to protect the good ole boy network as this town knows it. The John Klimm empire, overseen by 12 bozo's for a town council.
It really IS comical. But sad at the same time. It truly shows the CONTROL some in this town have. Will it ever change? Not till the voters get involved and see what we see. In the meantime, I will keep saying:
