One of the charges in Janet Joakim’s recall affidavit is a charge that she lied to voters in 2005.

In today’s Cape Cod Times Joakim is quoted as saying;

"None (of their accusations) are true.”

Excuse me Janet, but am I missing something here?

“Did the Town Council adopt the Split Tax Rate in fiscal years 2007, 2008, or 2009?”

Yes. Janice did vote for a token minuscule split tax rate in F/Y 2006 (1.15 – 1), “to wean commercial property owners to the added tax", but she reneged on her promise to support the split tax rate in each of the last three years.

Janet, isn't it true the Split Tax Rate, a legislature sponsored measure adopted by 112 larger cities and town, is a means to restore fundamental fairness between the commercial and residential property tax classes to pay the costs of education, police, health, general government, public works, town debt, recreation, etc?

Isn’t it true that the Mobile Station, in your precinct, on the corner of Route 28 and Old Stage Road paid a town property tax bill of $6,120 when you were first elected in 2001?

Isn’t it true that the Mobil station's tax bill this year is $1,942?

Isn’t it true that Mobil Oil Corporation, the owners and operators of the station, earned $11.4 BILLION, in the second QUARTER of this year,

and paid $4,187 less property tax this year than it did the year you arrived on the political scene in town hall?

Isn’t it true that your constituent’s property taxes went up 34% since you 2001,

while Mobil’s property taxes dropped 69%.

Isn’t it true that if you voted for the split tax rate, Mobil Oil’s tax bill this year would be $2,913,

and still be $3,216 LESS than the company's tax bill in 2001?

Isn’t it true that if you voted for the split tax rate every year since you were elected homeowners throughout town would have paid $28 million LESS TAXES?

Isn’t it true that $28 million isn’t chump change to Barnstable homeowners, and a drop in the bucket to Mobil Oil?

Isn’t it true that when you last ran for reelection in 2005 there were several tax relief measures on the ballot with you (Question 1, Question 2, and Question 3)?

Isn’t it true that you told voters in the Cape Cod Times, the Barnstable Patriot, and on a televised debate on Channel 18, that you would “vote to honor the wishes of the voters” on the three tax relief measures on the ballot?

Isn’t it true that you’ve said repeated during the last two years that you voted against the split tax rate because it would only save your constituents $26 a year, but increase your Hyannis relative's business tax bill by $500.

Isn’t it true adoption of the split tax rate would cut $162 from the tax bill of the average value home?

Isn’t it true Janet that the Zoning Board of Appeals (ZBA) resigned en masse last month?

Isn’t it true that the ZBA is currently made up of two members, neither of whom have heard a single case, and have a combined experience on the ZBA of 3 hours?

Isn’t it true that three of the six ZBA members who resigned had cumulative experience on the board seventy years?

Isn’t it true Janet that for the past 40 years permanent ZBA members were appointed from alternate members?

Isn’t it true Janet that you played a major role in the scheme to get your husband’s cousin, Niki Atsalis, who’s lived on the Cape only 2 of the last 17 years, appointed as a full member of the ZBA?

Isn’t it true that you played a major role in appointing complete novice,  Laura Schufelt, as a full member to the ZBA over John Norrman, who had served 3 ½ years as an alternate ZBA member?

Isn’t it true Janet that you lobbied the ZBA in May to deny Blanchard’s variance to move its liquor store just four blocks from your husband's cousin's (Silas Atsalis) family-owned liquor store, Cape Cod Package Store?

Isn’t it true Janet that after the ZBA denied your plea, you went to the Cape Cod Commission in your official capacity as President of the Town Council to ask the agency to take Blanchard’s project as a discretionary DRI referral? 

Isn't it true Janet that you didn't ask the Cape Cod Commission to take Cape Cod Package's expansion plans as a discretionary DRI referral?

Isn't it true that Cape Cod Package store's negative environmental impacts are far more serious since it is only four blocks down the road from Blanchard's project, but in a far more dangerous location (corner of Phinney's Lane and Route 28?

Isn’t it true Janet, that in an act of vengeance against John Norman who voted for Blanchard’s application, you appointed novice Laura Shufelt over Norman, inadvertently triggering the mass resignation of the ZBA because they felt their work to be compromised?

The truth is I feel sorry for you Janet, because each and every one of the question/statements is factual, which means your blanket one sentence broad brush statement (none of the accusations are true) in the Cape Cod Times today is yet another lie. 

Janet Joakim characterized the 350 precinct 6 voters who signed the recall affidavit, and recall petition, as "they with an agenda."

Janet the folks pointing a finger at you are your constituents who gave you the job in the first place. 

Joakim also said "There are more important issues to be addressed."  Are the more important issues;

the acquisition of the seven-acre Freezer Point property for $9 million, when the council could have bought it for $875K a few years ago.

whether to give Daddy Warbucks, Joe Keller, $250,000 of the town's money,

whether to give the Lorusso Trust special treatment so it can sell land in the industrial park to build a world class rich-people only nursing home on property zoned for industry and good paying jobs.

You can’t handle the truth Janet, and that’s why you’re being recalled.

2. WHY do the Town Attorney's DO EVERYTHING AGAINST the best interests of the voters and taxpayers here?

3. Why is the Town Manager STILL even employed? His EXCESSIVE GROSS WASTE is putrid! Or Janet, have you NOT seen HOW BIG John Klimm's empire has grown since he took over a few years back?

4.Why did the COUNCIL and MANAGER allow MILLIONS to be OVERPAID on a golf course worth MAYBE one third of what was WASTED on it? And the Hyannis Golf Course is LOSING so much money it makes me sick, as a taxpayer!

5.. The "Danforth Recreation Area".... THIS is PROBABLY the most DISGUSTING INSULT to every TAXPAYER in this town! And most people missed this one. So let me 'remind' people..... The ASSWIPES on the town council and the idiot Town manager ENDORSED and ALLOWED another $ 10 MILLION to buy the Marstons Mills Airfield. Not only was this LAND BANK PURCHASE ILLEGAL, more importantly today the land is surrounded with "NO TRESSPASSING" signs..... And the council and MORON John Klimm could care less! Janet, HOW MANY other towns used LAND BANK money ILLEGALLY like this? Try NONE, that I know of....

And let me remind people also that the sickening WASTE to buy the Hyannis Golf Course was ALSO illegal because the LAND BANK ACT prohibits any town from buying OPEN SPACE with BUILDINGS on ir OR buying OPEN SPACE with a BUSINESS on it!

Janet, HOW MANY TIMES did Gary Lopez and I TRY to stop all this gross INCOMPETENCE and WASTE?!

6. The MORE GROSS WASTE of taxpayer money to buy the decrepit Hyannis Water Company.....Here, the TOWN MANAGER AND COUNCIL conspired to screw the Hyannis water ratepayers by OVERPAYING $ 11 MILLION for the water company. John Klimm and the late Town Atty Bob Smith thought they were 'crafty and sneaky' so they ALLOWED the Seller, Conn Water some tax advantages whiel in the same breath, screwing the RATEPAYERS! How? These asswipes crafted the purchase to use $ 1 MILLON of land bank money which covered the 125 acres of land and made the WATER RATEPAYERS pay $ 10 MILLION for the actual components of a RUN DOWN DECREPIT WATER company on its last legs!

7. Spekaing of that water company purchase, let me remind everyone that the town ALSO that close to 3/4 of another MILLION was WASTED when Town Manager Klimm and the late Town Atty Bob Smith hired the LAW FIRM of Palmer *& Dodge from Boston to 'help negotiate' the purchase...
then Janet, no one did EVER answer my question: WHY did John Klimm do MOST of the negotiating with the CEO of the water company over a two year period?

And janet, here, remember this one I asked YOU and other MORONS on the council:

Imagine that.... Here we had a TOWN MANAGER who was all but negotiating a MULTIMILLION DOLLAR purchase with Barnstable TAXPAYER and he received that LETTER from the SELLER... and by the way, all indications are that the letter was sent from the CEO's home address!

8. And Janet, here answer this one! WHY is there now a MULTIMILLION RICO LAWSUIT against this town's Airport Commissioners? WHY did NO ONE ever even TRY to resolve that one? With SIX FULL TIME morons who call themselves Town Attorneys and NOT ONE even tried to step in to help resolve that fiasco, and NOW the TAXPAYERS will likely pay!

9. The latest LAWSUIT against the town..., one that is going to the SUPREME COURT this fall! Janet, hello, anyone home?! Here again, SIX FULL TIME LAWYERS on the BARNSTABLE TAXPAYER ROLL, and NOT ONE stepped in to help resolve this, and THIS is now going to the SUPREME COURT!!!! And the School Dep't has its OWN FULL TIME ATTORNEY?! WHAT THE HELL WAS HE doing all that time?

Judging from the traffic I'm seeing today, I'd say everyone in MA is reading about this recall. I think the whole State is feed up with hack politicians who disregard the wishes of their constituents.

Joakim should resign, and Klimm should retire to his reward in Brunswick, Georgia. Their legacy is secure; it will take years to clean up the public mistrust and financial abuses left in their wake. Are there any bogus municipal awards for sale currently?

This town welcomes lawsuits. Ruth Weil smugly stated recently that her reaction to those threatening litigation against the town is the same as her predecessor Bob Smith: "GET IN LINE!"

Lawsuits are not the answer. As long as the charter provides for it, recalls are the best way to go.

Recalls only take a few months. Lawsuits take several years. Get rid of Joakim and let the healing begin.

And HOW MUCH does THIS cost the Barnstable taxpayers? From ALL that I can tell, this WASTE comes to somewhere OVER $ 1 MILLION a year......All the while, YOUNG STRUGGLING PARENTS are still stuck with the putrid sickening BUS FEES and many SENIORS are PAYING FAR TOO MUCH on their homes that are WAY OVERASSESSED! In MANY cases, homes in this town are OVERASSESSED anywhere from 15% to as high as 35% in some cases!

So here we have this clueless Town Manager who continues to RIP the taxpayers blind! Live within one's MEANS? Yes, MOST hardworking people in this town are NOW FORCED to live within one's means, BUT NOT JOHN KLIMM. And NOT the town council. SOMEONE FORGOT to tell these MORONS that there is a SERIOUS recession on the Cape.....

Look at what happened in Yarmouth..... And NOW look at what is happening there.... and NOW listen to the WHINERS.... Wah, wah, wah, there will be more crime. There will be people dying in fires..... Wah wah wah.... Get USED to reality folks! MONEY only goes so far! Hell, these people would have a police station and firehouse on EVERY CORNER if we let them!

For anyone new here, the citizens USED to be 'allowed' 4 MINUTES to speak at the town's public comment.... then it was REDUCED to THREE MINUTES and in most cases NOW people get to speak for TWO measly minutes, UNLESS of course you happen to be some FORMER councilor who strolls to the town podium to KISS the council's ASSES and tell them all how GREAT they are doing and what a shame it is that some 'gadflies' come each week to pounce on them!

Ah, Janet, alias Able Kane, ah, that was ONE THOUSAND and SIX HUNDRED and thirty three OPEN LAWSUITS against OUR TOWN! Ah, ah, ah, as the late Town Attorney Bob Smith used to say....

And in that same fiscal year, 604 were CLOSED. Great, but OOPS, another 269 NEW cases were ADDED....

So MY MATH telles me that there are STILL ONE THOUSAND and TWO HUNDRED AND NINETY EIGHT OPEN PENDING CASES LAWSUITS against OUR TOWN!

Gee, now THERE is a GREAT STORY for the Cape Cod Times reporters! Hey there is a great IDEA! Go work on this one:

1. HOW MANY TOWN ATTORNEY's does EACH town have? What do they do?

2. HOW MANY CURRENT OPEN PENDING LAWSUITS are there against EACH town? How many of those are simple 'highway DPW' cases?

3. Go ask the Town of Falmouth Town Administrator HOW FEW open cases lawsuits they have against their town?

4. Get a RECORD from EACH town Manager or administrator HOW MUCH each town PAYS out to OUTSIDE LAW FIRMS for OUTSIDE LEGAL SERVICES?

I called the Town of Barnstable Finance Director Mark Milne today to see if he received my FREEDOM OF INFORMATION request that i placed yesterday. He said "Yes". I asked him WHEN he plans to have my answer of HOW MUCH the Barnstable TAXPAYERS have had to WASTE on paying OUTSIDE LAW FIRMS for the past TWO fiscal years? He told me he will have it next week, and he will "call me".
