Caesar was assassinated on the Ides of March (March 15), 44 BC, after declaring himself dictator of Rome for life.

Clark, et al, are holding a party tomorrow to make John Klimm dictator of Barnstable for the rest of his life. 

We don't need to assassinate Klimm, but we can be just as effective as the Roman Senate Liberatores who stuck a shiv in Caesar,

with a passive and silent absence from Clark's party that will send a loud and clear message;

the proposed charter sucks,

In reality the town charter is a

contract between all of us to maintain social order.

Social contracts typically means each of us cedes some of our rights to town hall to receive or maintain social order.

The authority granted to elected and appointed town officials is derived from the

consent of the governed as delineated in the town charter.

The social contract and the civil rights the town charter is supposed to give us should not permanently fixed.

The contract, or town charter, is the means towards an end —

for the benefit of all —

When failings are found in the ideal charter,

there should be provisions to renegotiate to change the terms, but are virtually absent in Clark's charter.

The preamble to Clark’s folly asserts the document is reads like a contract;

"The people of the Town of Barnstable, desiring to manage their affairs in an honest, forthright, and efficient manner, and wishing to participate most fully in exercising the rights and responsibilities of local government, and praying for the minimum of interference from the yet larger state, do adhere to this charter."

"We assert our willingness to assume all responsibility for the conduct of matters pertaining to the town, and do by this document earnestly affirm our right as inhabitants of Barnstable, to live and grow in freedom, dignity, and tranquility."

Since civil rights come from a mutual agreement to the charter, those who choose to violate their contractual obligations abdicate their rights, and the rest of society is expected to protect itself against the actions of these outlaws.

As members of the Barnstable society we must accept the responsibility for following its rules, and the threat of punishment for violating them,

but the council and town manager need similar rules which are absent in Clark's charter.

The town charter is mutual coercion, mutually agreed upon, which means we must take the effort seriously.

Clark's charter doesn't pass the laugh test, so it must end today, not tomorrow.

Clark’s charter lacks a form for us to redress grievances, an element of our First Amendment rights, to wit;

the right to recall elected officials,

and to meet in open session with elected and appointed officials to discuss grievances (Open Meeting of the Voters);

   the lack of these provisos is enough to put a "DOA" toe tag on Clark's folly today.

Under Clark's charter citizen complaints will be limited to two minutes during public comment under such strict rules to effectively rule out redress.

Come election time one or more council or school committee candidates may come knocking on your door for a five minute spiel.

Couple the chat with sound bites on the radio, a few terse paragraphs outlining his or her goals in the local newspaper,

and your total involvement with the candidate-elect could total 30 minutes.

In Clark's charter you will have to live with this stranger for four years with no possibility of divorce, separation, or recall,

which is unnatural in this world where everything comes with at least an implied warranty.

If it’s defective, stale, sour, putrid, or unsafe you can replace it or get your money back, except for a corrupt politician under Clark's charter.

Not only does Clark’s folly postulate that you buy the candidate in “as is” condition,

but he also takes away your right to bitch about it in a public forum.

Clark doesn't have the chutzpah to call Barnstable what it is;

a CITY.

Provincetown, Wellfleet, Truro, Eastham, Orleans, Brewster, Chatham, Dennis, Mashpee, and Bourne are towns.

Barnstable, like Beantown, is a City.

Section 1-1 Incorporation of Clark’s charter says;

The inhabitants of the Town of Barnstable, Massachusetts, within its territorial limits as now or may hereafter be established by law, shall continue to be a body politic and corporate, known as the "Town of Barnstable."

"The Town of Barnstable shall constitutionally have a city form of government."

Clark's the kind of guy who until he began to shave carried a phony birth certificate showing he was 11 years old so he wouldn’t have to pay for a 12 and up adult ticket at the movies.

This section of Clark's charter is scary;

Clark’s folly starts out with deceit because his charter is one-sided,

and was created with malice aforethought.

Clark’s heavy-handedness may be fine for his company, Oceanside Destruction, because his employees have the right to quit, and customers the privilege of going elsewhere,

but he doesn't give those of us who are stuck here any options.

In just about everywhere in the United States,

except Southbridge,

Watertown,

Winthrop, and

Barnstable,

voters get to elect both the executive and legislative branches of local government.

All of us get to elect the President (Executive Branch) and Congress (Legislative Branch), Governor (State Executive Branch) and General Court (Legislative Branch).

In other local governments people get to elect the Mayor (Executive Branch), and Councilors (Legislative Branch), and Town Meeting (Legislative Branch) and Board of Selectmen (Executive Branch). 

In many states the people elect judges, including Supreme Court Justices.

People in most states have the power to recall miscreant elected officials including Supreme Court Justices (remember Rose Bird?)

The towns of Watertown, Winthrop, and Barnstable all have problems with their town manager/town council form of government, which leaves the poor little town (Pop. 10,000) of Southbridge as the only community with a peaceful serene town council/town manager form of government in Massachusetts.

Instead of coming up with an original charter, Clark and his buffoons simply

plagiarized the old charter and added a few tweaks to further limit citizen’s rights.

If we can't elect our chief executive, then we’re better off with what we had up until 1989;

The best way to show your contempt for the proposed charter is to

        NOT ATTEND

the meeting charter commission hearing tomorrow,

or any future meetings

 

because the charter commission has only enough time for band-aids

He will be investigating the "airport search committee workshop" that suddenly turned into an Airport Commission Meeting in which Bud Breault was hired as Airport Manager.

Yes we were for the charter and we had seven candidates running.

Unfortunately none were elected although we weren't that far out of it (less than 100 for two candidates.

It wasn't a bad showing for unknown's with little money to spend.

The very next day after the election after I saw who the winner were, I wrote a post that the charter would be crap.

Clark?? Rohrbach??? Richardson??? Geiler???
Jones??? all town hall bottom feeders that made up the majority.

As far as not showing up; the charter commission gave everyone who wanted a mayor the finger from the get go.

Now with three weeks to go before they have to send it in, they want people to comment. Why?

I called Richard Clark right after he was elected, but he didn't want to hear anything, and I've known him for fifteen years.

My kid and his played soccer together for years.

I predict the charter will fail 85% - 15% in November.

Going there tomorrow will give the rag more credibility than it deserves.

Klimm says he'll lay off 40 people, which means the number will unexpectedly climb to 80.

Grenier says she'll lay off 100 which means the number could climb to 150 once the names are released and the bumping process begins.

The people who will be gone are the new hires at the bottom of the wage chain as they'll be bumped by seniors who make 2 1/2 times as much.

Remember Grenier will have to pay 1/2 of the unemployment for everyone she lays off for one year.

She's trying to cut dollars, not people, so the number of people will have to increase, and the economy hasn't hit town hall yet.

The schools will be level funded by the state.

The town will lose $300,000 in lottery aid because lottery sales are down.

The reason we're in the jackpot is the council robbed the town's savings for $20 million over the last three years.

$11 million in F/Y08 alone.

That's like buying a BMW from your IRA and driving it for a year, and having it repossessed this year.

The council ate high on the hog last year, and next year they'll be picking meat from the hog's head.

COG called the council, but the voters folded.

Cahoon will be elected in November. A just reward for a guy who just put the school through a $6 million deficit.

So what did we do? We TRIED to CHANGE all this, from a SICKENING PUTRID WASTEFUL CORRUPT CLOSED town so called government into what the PEOPLE HERE WANT:

AN OPEN HONEST CARING TOWN GOVERNMENT!

So we went out and collected about SEVEN THOUSAND signatures from REGISTERED VOTERS here. In our process we TALKED to MANY of these 7000 PEOPLE and they told us they were SICK and TIRED of the FILTH and corruption here and they wanted two simple things:

They wanted:

1. ACCOUNTABILITY

2. AN ELECTED MAYOR!

The people in this town WANT OPEN AND HONEST GOVERNMENT!

So what happened?

A BUNCH OF GOOD HONEST people ran to be elected onto this charter commission. A BUNCH OF SCUMBAGS also ran. And who go elected? A couple good people with good intentions., small problem though...

Roy Richardson is a FOMMER town COUNCILOR and FORMER COUNCIL PRESIDENT. Mr RICHARDSON ALSO NEVER even SIGNED the charter PETITION and yet he RAN to be ON this charter commission!

And next, Sue Rohrbach. She USED to be a SELECTWOMAN in town. She ALSO works for the Senator from Cummaquid. Know that GUY named O'Leary? The man who FORGOT TO file his TAXES? Yeah, HIM!

And finally, Sheila Geiler. KNOW WHO HER HUSBAND IS? He RUNS the town'd REGULATORY SERVICES division!

Gee now, what a small coincidence.

According to the law it is supposed to go to the town council for ratification/explanations/minority report 18 months after the charter commission was elected (November, 2007).

From there it goes to the department of housing and community development and to the attorney general.

The charter will be on the ballot in the November election.

Been a while since I posted, but have been reading daily. Good to see everyone is still active.

The problem with the Charter is the same as everything else in this town. Those in charge make things happen only to suit their own agenda, and of course ignore what us lowly taxpayers have to say.

The position the Charter commission chose to elevate is the President of the Town Council. I know I was looking for the change to be the Town Manager's position to be elected. This is the only thing that makes sense to me and would better model our state and federal structure. I believe many in this town would support (overwhelming majority) this type of a change, I just hope that most people see what the commission proposes is NOT that kind of move.

As I said, this attitude of our elected officials is typical. Take for instance the conservation commission. When I applied for time on the commission agenda to present a proposal, I was told I needed to get a nod from the state first. Well, I did that (after 6 months) and now, the commission won't even allow me 10 minutes on the meeting agenda to make my case. It seems like they just don't want to hear it.
